Entry rules for raffles organized by Air Berlin PLC & Co. Luftverkehrs KG

These general entry rules apply for all online raffles organized by Air Berlin PLC & Co. Luftverkehrs KG ("airberlin") or affiliated companies. Additional rules may apply and shall have priority over these rules. 


1. Entitled Participant / Participation

Only persons aged 18 years or older may enter raffles organized by airberlin. Employees of airberlin (including affiliated companies) and their dependants are not permitted to enter the raffles. 

All participants of the raffle are obligated to submit all data in a complete and correct manner. Participants take part in the raffle by correctly filling in the application form and pressing the Button "participate". 

Entries may not be submitted via a competition entry service; only personal entries sent in by individuals are permitted. Participation is possible only within the timeline provided in the raffle description. In the event of suspected technical manipulation or any other breach of these rules, airberlin reserves the right to disregard the participant(s) concerned for purposes of the draw. In such cases a prize may be subsequently disallowed and a new draw can take place to determine a substitute winner. Each participant may only win one prize even he / she is part of a player community.


2. Determination of the winners

The winners are determined by airberlin, its employees, agents or authorized third parties, according to the method depicted in the raffle.


3. Winning notification

The winner will be sent the price within 3 weeks once the draw has taken place or he / she will be contacted by e-mail. The prize is forfeited if the winner fails to acknowledge notification of having won a prize and / or if the prize is not taken up within the specific period. 

The prize is subject to availability as well as certain limitations concerning travel periods and booking classes. Online availability is irrelevant. The winner is required to bear travel expenses to and from the location where the prize comes into effect, as well as other expenses unless such expenses are explicitly mentioned as part of the prize. Miles under the topbonus program cannot be earned for flights offered as prizes. There are no cash alternatives to the prizes, nor can they be modified, exchanged or transferred to others (especially via online auctions). airberlin’s decision is final.


4. Liability

airberlin bears unlimited liability in the event of criminal intent or gross negligence or if a guarantee has been provided. Liability in the event of ordinary negligence is unlimited if there is injury to life, body or health.  In the event of ordinary negligence relating to a breach of major contractual obligations, liability shall be limited to the resultant damage to material and property items up to the amount of the foreseeable loss typically incurred. Any further liability for damages on the part of airberlin is excluded. This does not apply to claims based on the German product liability act and regulations under the Montreal Agreement. The company indicated on the voucher is responsible for the performance of the service offered as a prize.

The winner must ensure to be in possession of those documents, which may be necessary for travelling abroad (passport, visa, etc.) as well as for the recommended insurances (e.g. health insurance).


5. Data Protection

As part of the raffle, personal data of the participants are collected (see application form). These data will be stored and used exclusively for the execution of the raffle and will be deleted after its end. Participants may withdraw their consent to the collection of voluntarily transmitted data at any time without any reason being required by sending an email to: webmaster@airberlin.com or a letter to: Air Berlin PLC & Co. Luftverkehrs KG, Saatwinkler Damm, 13627 Berlin. Should a participant request deletion of its data, a further participation in the raffle is no longer eligible.


6. Termination of the raffle

airberlin reserves the right to cancel or terminate the raffle due to unforeseen circumstances without prior notice. Such unforeseen circumstances may be (but not limited to) hard- and / or software errors, and / or other technical and / or legal reasons which make the regular and orderly conduct of the raffle impossible. 


7. Applicable Law

The raffle is subject to the laws of Germany. If any term or provision in these rules shall be held to be illegal or unenforceable, in whole or in part, under any enactment or rule of law, such term or provision or part thereof shall to that extent be deemed not to form part of these rules and the validity and enforceability of the remainder of these rules shall not be affected.
